Historical Study of Turkic Muslim Communities in European Russia

European Russia, or the European part of Russia, is the area located to the west of the Ural Mountains and north of the border with Kazakhstan. Russia’s Volga-Ural region—that is, the middle and lower Volga River and the southern Ural Mountains—historically have had Turkic Muslim residents. Nowadays most such people identify themselves as Tatars or Bashkirs (Bashkorts). I am studying various aspects of their historical communities, which they maintained as Muslims. In Russia, some of these areas have a particularly multiethnic and multireligious (multiconfessional) character, and the Volga-Ural region is one of them. I am aiming to shed light on “ordinary” Muslim families and social life in those surroundings. I think that such an approach to these interests and themes is highly significant now, because more and more emphasis is being put on the “multiethnicity and multiconfessionality” of Russia in Russia per se.

Principal areas of interest
● Ulama as specialists on Islamic law under Muslim administration in the Russian Empire.
● Legal and social history of application of norms derived from Islamic law in Muslim communities.
● Islamic reformist thoughts and debates among ulama in the Russian Muslim press at the beginning of the twentieth century.
● Islamic law, Islamic education and human networks among ulama in Central Eurasia (especially in the Volga-Ural region and Central Asia).
● Ulama in the early Soviet period.

    本研究の初年度である2022年は、新型コロナウイルスの流行に伴う渡航規制が若干緩和されたものの、まだ海外における調査をコロナ以前のように実施することはできなかった。ただし、国内においては対面での研究会開催が本格化するなど状況は好転している。結果として、海外における資料およびフィールド調査については遅滞が生じているものの、国内の各種研究会、および資料分析についてはほぼ事前の計画通りに研究を遂行することができた。以下、本年度の実績を記載する： 【海外での調査】8月に磯貝（健）、磯貝（真）の2名がウズベキスタンに出張し、タシュケントの東洋学研究所で資料調査を実施した。さらに、ヒヴァの国立イチャン・カラ博物館にて館長と面会し、同館所蔵文書の研究におけるパートナーシップの継続を確認した。ただし、同月から9月にかけて和崎が実施する予定であった現地での聞き取り調査はキャンセルとなった。 【国内での研究会】7月に京都、12月に静岡で「近代中央ユーラシア比較法制度史研究会」を実施した。京都開催回では畠山が、近代ロシア家族史の研究動向について報告し、静岡開催回では阿部が、サファヴィー、カージャール両朝統治下のコーカサスにおけるシーア派相続法にかんする報告を行った。また、静岡開催会では「トルキスタン統治規程」の翻訳研究会も併せて実施した。さらに、2023年3月には「中央アジア古文書研究セミナー」を、対面参加者数の制限を廃した上でハイブリッド形式にて実施し、30名前後の参加者を得た。

    1. 史資料の所在調査と収集について、報告者は、前年度からの課題であった、ロシア連邦カザン市とウファ市における作業を実施した。カザン市ではカザン連邦大学ロバチェフスキー名称学術図書館手稿・稀覯本室、ウファ市では特にバシコルトスタン共和国国民文書館を利用し、後者では計画通りオレンブルグ・ムスリム宗務協議会の公文書群から必要なものを写真撮影によって複写した。ウファ市では、ロシア科学アカデミー・ウファ連邦研究センター歴史言語文学研究所のアイブラト・V・プシャンチン所長とマルスィル・N・ファルフシャートフ研究員より助力を得た。 2. 史資料の読解と分析について、報告者は、特に交付申請書記載の研究課題(1)については前年度行なった口頭報告の結果を踏まえて再考し、国際ワークショップでの口頭報告、および国際カンファレンスに際して公刊された論集への寄稿というかたちで再度まとめた。研究課題(2)のための作業も行なったが、その結果の公開まで進めることはできなかった。 3. 研究結果の公開について、報告者は国際ワークショップで、「Muslim Marriages and Divorces in the Late Nineteenth-Century Volga-Ural Region」という口頭報告を行なった。その内容は、「法多元主義（legal pluralism）」の概念を使ってロシア帝国の法制度を説明することの適切性を、法制度のみならず、その運用実態から得られる情報もあわせ、議論するものである。報告者はこれを論文にまとめ、ロシア連邦オレンブルグ市で開催された国際カンファレンスの論集で公開した。 4. イスラーム法の専門家であるウラマーの研究を進める一環で、上述のファルフシャートフ研究員と共同研究を行ない、その研究成果を国際共編著の書籍『“My Autobiography” by Hasan `Ata' Gabashi in 1928: `Ulama' and Soviet Power』として公刊した。

    We had study meetings 30 times through which we analyzed the part of law of obligations of the Ottoman civil code (Mecelle) both collectively and individually. As a result, we published Japanese translation of the Books of Sale, Hire, Guarantee, and Transfer of Debt. We translated the Books of Pledges, Trusts and Trusteeship, Gift, Wrongful Appropriation and Destruction tentatively, then studied them in comparison with the other laws of obligations. These tentative translated Japanese texts are to be basic materials for comparative study of law of obligations between Islamic law and Western modern law, and making Mecelle as 'Modern Middle Eastern Law' model. We also held the international workshop related to Mecelle in Japan, and the research group leader had the invited presentation in the international Mecelle symposium held in Turkey, where he talked about this research project.

    This study revealed various aspects of transformations of legal systems and societies brought about by the Russian administration in late 19th-century Muslim Central Asia, i.e., the Turkestan krai of the Russian Empire and two Russian protectorates, the Emirate of Bukhara and the Khanate of Khiva. The study marshaled the stipulations of Russian laws on the Islamic courts in the legal system of the Russian Empire and made clear details of its influence on the traditional Muslim court practices; for example, ‘ulama’s (Muslim legal scholars) of the krai began to write a new particular kind of court documents. In addition, we explained similar transformations in the Muslim societies of the Volga-Ural region and the southern Caucasus. And for better understanding of characteristics of laws and imperial administrations, our study eventually conducted a comparative study between the Russian administration and that of the Qing Empire or the Republic of China.

    The present study makes an attempt to clarify a concrete picture of the Turkic Muslim society in the Volga-Ural region in the late 19th Imperial Russia by analyzing legal institutions and practices of Muslim family and community. Our study particularly explains the institution of Muslim inheritance "according to Sharia law" in the judicial-administrative system of the Empire, and also reveals its actual practices. Major materials examined in our research are judicial-administrative documents from the fond of the Orenburg Muhammadan Ecclesiastical Assembly at the Central State Historical Archives (Tsentral'nyi gosudarstvennyi istoricheskii arkhiv) of the Republic of Bashkortostan in the Russian Federation. Our research explains that qadis of the Ecclesiastical Assembly and imams of mahallas as parish communities dealt with cases of inheritance on the basis of the laws of the Russian Empire procedurally on the whole, while following Islamic law in general for substantive legal issues.

    On the basis of the concept of "prestige language" and "common language", we attempt to reconstruct the interpretation of the 16~19th century Asian history from an angle of multi-cultural communities which represented the cultural identities of these areas. And in this study, we demonstrated two cultural areas. One is the “prestige language” such as Chinese and Arabic language areas which had been reconstructed to “common language”, and the other, such as Malay and Persian language areas-the conventional “prestige language” which were in crisis of colonization, had been replaced by the new common languages-Indonesian, Indian indigenous languages, and English.

    This research project sheds some light on actual conditions of Turkic Muslim communities in the middle Volga and the south Ural regions under the rule of Russian Empire from the latter half of the 19^<th> century to the Revolution of 1905. It analyzes Muslim family and community, and its principal research method is that of social history. It(1) explains the judicial-administrative system and actual conditions of its practice concerning inheritable estate division problems among Muslim people, and(2) prepares a future historical demographic and family-social historical study of Muslim parish registers.

    The formation of national intellectuals and the development of university network in the regions under the rule of Russian Empire, where non-Russian national/ethnic groups composed the majority, were analyzed on the cases of the grand duchy of Finland(Finns and Swedes), Baltic provinces(Estonians and Latvians), western provinces(Poles and Lithuanians), Caucasia(Georgians and others), and Volga-Ural region(Tatars). Besides it, activities of non-Russian professors and students of higher schools in Saint-Petersburg were discussed on the ground of archival materials.
