    BACKGROUND: Healthcare professionals use the ethics of justice and care to construct moral reasoning. These ethics are conflicting in nature; different value systems and orders of justice and care are applied to the cause of actual moral conflict. We aim to clarify the structure and factors of healthcare professionals' moral conflicts through the lens of justice and care to obtain suggestions for conflict resolutions. METHOD: Semi-structured interviews about experiences of moral conflict were conducted with Japanese nurses recruited using the snowball sampling method. Interviews were conducted based on the real-life moral conflict and choice interview. Interviews were recorded and transcribed verbatim, then analyzed based on the interpretive method of data analysis. Verbatim transcripts were read four times, first to get an overall sense of the conflict, then to understand the person's thoughts and actions that explain the conflict, and third and fourth to identify perspectives of justice and care, respectively. Each moral perspective was classified into categories according to Chally's taxonomy. RESULTS: Among 31 responses, 2 that did not mention moral conflict were excluded, leaving 29 responses that were analyzed. These responses were classified into six cases with conflict between both justice and care perspectives or within one perspective, and into two cases without conflict between perspectives. The "rules" category of justice and the "welfare of others" category of care were included in many cases of conflict between two perspectives, and they frequently occurred in each perspective. CONCLUSIONS: The nurses in this study suggest that they make moral judgments based on moral values that are intertwined with justice and care perspectives complex manner.Organizational, professional, and patient-related factors influenced conflicts between justice and care. Additionally, multiple overlapping loyalties created conflicts within justice perspectives, and multifaceted aspects of care-provider's responsibility and patient need created conflicts within care. Decision-making biased towards one perspective can be distorted. It is important to consider ethical issues from both perspectives to resolve conflicts, especially the effective use of the ethics of care is recommended.

    BACKGROUND: No laws or official guidelines govern voluntary assisted dying (VAD) in Japan. A legislative bill on the termination of life-sustaining measures has yet to be sent to deliberations for legislation, due to strong opposition that has prevented it from being submitted to the Diet. However, Japan has recently witnessed several cases involving VAD. MAIN TEXT: Against this backdrop, we argue that Japan should begin discussion on VAD legislation, referring to the Voluntary Assisted Dying Act 2017 (VADA2017), which was established in 2017 in Victoria, Australia. VADA2017 puts in place a wide range of stringent safeguards and is considered worldwide to be the safest and most conservative policy on a physician offering assisted dying based on the patient's premeditated request. We consider what opposing opinions from society would arise in response to the VADA2017. Among these will include arguments against VAD itself, those against the validation of this act, and opinions that oppose even the initiation of the dialogue on VAD. CONCLUSIONS: We conclude that to protect the right to life among those placed in vulnerable positions and, at the same time, to respect decision-making of those who wish for immediate death due to unbearable suffering, the dialogue must immediately begin with that on introducing a policy more conservative than that of the VADA2017, which solidly considers arguments against VAD.

    BACKGROUND : In Japan, clinical ethics support services are only available at certain institutions. The actual conditions surrounding ethics consultation are unclear with few resources available for determining its efficacy. The object of this study is to clarify the expected outcome of ethics consultation and identify the appropriate mode. We also aim to elucidate the ideal consultant and the obstacles to achieving full utilization of ethics consultation.<br>METHODS : Eighteen medical practitioners participated in the study. We held semi-structured interviews and analyzed these interviews by qualitative content-analysis technique.<br>RESULTS : This study suggests that specific advice, new insights from outside parties, emotional support, and an appropriate process based on a division of labor between medicine and ethics all contribute to a team-based practice of medicine that avoids the arbitrariness and dogmatism of single practitioners. It is also indicated that timeliness and swift answers are required. Knowledge of medicine and ethics, communication skills, a close familiarity with actual conditions in medical practice, and empathy toward the medical staff were found to be as important as the qualifications of consultants. Contrarily, the participants suggested that the busy pace, lack of psychological breathing room, medical practitioners' pride, lack of awareness of ethical issues, and the negative image of the word "ethics" were significant impediments to achieving full utilization of ethics consultation.<br>CONCLUSIONS : The present study is the first of its kind to reveal the views of medical professionals regarding clinical ethics consultation in Japan. Further research is required to identify the features of a consultation system that can be easily accessed and effectively utilized in Japan.

    Many of today's guidelines for professional medical ethics pertain to the prioritization of patients' benefits. At face value, this prioritizing is considered to be a physician's professional duty. In this paper, we argue that supererogation, a morally valued action that transcends a physician's professional obligations, exists and should be properly distinguished from professional duty. We maintain that, in the long run, an advantageous result will be achieved by distinguishing the two. It is also claimed that supererogatory acts are fundamentally good when conducted thereafter fulfilling one's basic professional duties and social obligations as an individual in society.

    The development and maintenance of trust in the physician-patient relationship is essential for the practice of high quality health care. However, distrust of medicine has been more serious in Japan recently. The purpose of this study is to explore the factors of patient trust and distrust in physicians among Japanese. We conducted 25 semi-structured interviews with Japanese citizens based on grounded theory approach. Categories regarding patient trust included (1)physician's competency, (2)appropriate responses to patients, and (3)emotional aspects of the physician-patient relationship. Ten sub-categories were derived from these categories, which included physician's reputation, personal and social characteristics of the physician, outcomes of the treatment, physician's appropriate manner, full disclosure of medical information and informed consent, respect for patients' interest, limit of providing enough care, sympathy and compassion, physician's communication skill and communicability, patients' emotions. The result of our study shows that some parts of the patient trust we figured out were similar to the factors found in the previous studies done in western countries. However, some parts of the sub-categories we found out seems unique to our culture. More detailed analysis on characteristics of Japanese interpersonal relationship will be needed.

    This paper has two aims, to summarise recent domestic and international events related to medicoethical-legal decisions in the clinical setting and to discuss the ethical implications of these events. Domestic issues include brain death and organ transplantation, refusal of treatment for religious reasons, disclosure required for legitimate informed consent, surrogate motherhood, prenatal diagnosis and selective abortion, issues pertaining to HIV/AIDS, concealment of medical mistakes, truth telling, public trust in physicians and in health care, and medical research. International issues include voluntary euthanasia and assisted suicide, the imposed separation of conjoined twins, problems pertaining to wrongful life, fetal surgery, the Icelandic database, homosexuality, resource allocation and global justice, and the death of participants in medical research.<BR>It is hoped that this review of recent events related to clinical ethics may serve as a basis for ethical considerations in daily practice.

    Japanese pysicians often confront various ethical dilemmas in clinical settings. Our study showed that 20 to 40% of clinical cases involved difficult ethical dilemmas. Such dilemmas often happened in the context of physician-patient-family relationship. We, therefore, presented actual clinical cases involving difficult ethical dilemmas and tried to analyze them in order to consider the validity of both of processes and decision made, using 13-item framework. A proposed framework includes the following questions : what is an ethical problem at stake, who consider it problematic, what is medical situation, what opinions the parties concerned have, are there any emotional problems or conflict of interest, who disagrees with the proposed plan, what do (did) they do to resolve ethical dilemmas, are all of the parties convinced or satisfied with the decision made, and finally, is the decision made ethically valid? This process could make an obscure sense of discomfort in clinical cases clear and enable all of the parties concerned to discuss the problem, focusing on the point the parties or persons concerned disagree. A standard process would also be useful to distinguish ethical problems from emotional ones or conflict of interest. On the other hand, judging ethical validity of each decision is still difficult because there is no consensus in regard to what ethical principle should be applied to clinical decisions in Japan at this moment. Thus, it is crucial for us to decide what is ethically right in Japan and how to use ethical guidelines that could be a basis for deliberation on ethical validity. We need to develop validated and consistent process to reach the ethically appropriate decision.

    When a physician cannot determine solely medically which course of action he or she should take, his or her decision-making in patient care often requires value judgments on an individual basis. Such a decision with value judgments is usually regarded as ethical decision-making. Ethical decision-making tries to resolve ethical dilemmas that raise when a clinical problem in patient care has plural countervailing resolutions. A physician has to make a choice among several unsatisfactory alternatives in clinical practice. In situation where conflicting two or more actions seem equally legitimate, it is not always possible to resolve ethical dilemmas themselves, rather, his or her decision has to be made even amidst unsolved ethical dilemmas. Furthermore, as far as clinical judgment regarding what is ethically right or wrong depends on value judgment, ethical decision-making made by an individual physician would be unavoidably biased by his or her idiosyncratic value. Under these circumstances, clinical ethics can offer a physician standard guidelines and fair procedures to deal with ethical dilemmas confronted in patient care. Ethical guidelines including decision-making priority used in clinical ethics provide physician's ethical decision-making with consistency and fairness. A framework of ethics consultation is useful to identify, analyze, and cope with ethical dilemmas in systematic manner. Even if an approach in clinical ethics failed to resolve ethical dilemma themselves, its procedure could result in a fair decision acceptable to a patient, physician, and all other parties. Ethical dilemmas in modern medicine may not be resolved, but clinical ethics would help a physician deliberate ethical problems and negotiate a mutually acceptable decision amidst disagreement.

    Should we respect treatment refusal of incompetent patients who cannot decide forthemselves? What principle or reason could justify compulsory interventionsagainst the patients' will? This paper deliberates various factors that possiblyinfluence our attitudes toward an incompetent patient's refusal of treatment.Issues discussed would include standard treatments at a given time in a givenculture, advance directives, perpetuity of incompetency, nature of refusedinterventions, alternatives, emergency, ethical and medical uncertainty, ourdiscriminatory feeling, human dignity, fundamental liberty, and patient's moralobligations. We conclude that compulsion against incompetent patients should beexceptional and must not be forced unless there is a serious reason.

    In this brief paper, I would discuss a great boon and tragedy of experimental treatments. Although medical experimental treatments including clinical research that involves human subjects are essential for medical progress and our happiness, innovative interventions and experimental therapies could bring about unforeseen results and have enomous impacts on those who concerned. Research ethics is undoubtedly important to protect human subfects and their relatives and it does work in many cases. It is possible, however, that tragedies unavoidably ensue. Ethical analysis regarding a movie named "Awakening" and "Charly" will reveal absurdity and sorrow in our lives.

    2020年度は、AI/IoTなどの新規情報技術が医療現場に参入した際、それら分析・個別化された決断根拠に関する情報は、患者の「思考する意識（理解・認識・価値・規範/価値観）」に対してどのように作用し、影響するのか。さらには、意思決定プロセスに対してどのように作用するのか、という問いに対して、以下の分担事業を行った。 <BR> １．高度情報技術が実装された臨床現場における患者の医療に関する意思決定プロセスに関する質的分析（菊地グループ）：2020年9月に東京医療センター倫理審査委員会での承認を受けたのち、自らが患者として臨床上の重要な意思決定に関わる体験をした方々に対して個別インタビューを行うとともに、理論形成補完を目的としたグループインタビューも実施した。現在、インタビューによって得られたデータを解析し、ボトムアップでの理論形成を開始している。 ２．人生を変える健康関連情報を知った患者の賢明な臨床意思決定を実現するための考察（浅井グループ）：当該テーマにおけるシステマティック・レビューを行い、すでに論文投稿を完了し、掲載予定の段階である。 ３．“患者-医療者関係”から、“”患者-情報技術-医療者関係“へと健康情報を取り扱う関係性が変化したときに予想される変化と懸念、さらにはその対策に関する概念モデル形成（松村グループ）：実証データの分析も踏まえつつ、近未来において、臨床情報の取り扱われ方が変化し、人工知能などの情報技術が参入した場合における懸念事項と対策についての理論化を進めている。2021年度中には分析および論文化まで終了する見込みが立っている。

    We tried to analyze the ethics in our society using the two principles of human relationship: "live by helping each other" and "live and let live," and recognized that, e.g., Paternalism, besides Aristocracy, was natural and even might have been appropriate in societies where the former principle was dominant, while respect for autonomy is absolutely recognized in those where the latter one is dominant. In Japanese society nowadays, by contrast, a balance between the two principles should be sought, which can be actualized in medical contexts by our version of shared decision-making. <BR> "Post healthy life-span" is the period when elderly people are living with frailty. It is said to last for about ten years on average. The period is appropriately understood as "end-of-life period" and advance care planning (ACP) for this period should be promoted. We made support tools for elderly people's ACP, as well as contributed to some authorized guidelines for ACP.

  6. Studies on surrogate decision-making in Japanese medical practice

    There are research findings from two studies including a qualitative survey and large-scale cross-sectional survey. The qualitative study with 14 interviewees, we extracted 4 core categories, 17 categories, 35 subcategories, and 55 codes regarding judgement grounds in surrogate decision-making. The four core categories included patient preference-oriented factor, patient interest-oriented factor, family preference-oriented factor, and balanced patient/ family preference-oriented factor. The last core category represented attempts to balance the preferences of the patient with those of the surrogate decision-maker. The large-scale cross-sectional survey on 1000 respondents suggested that only 48.8% of the surrogates reported no knowledge of the patient having expressed their prior intentions regarding medical care in any form. Although many participants based their decisions on multiple grounds, surrogates’ considerations may not adequately reflect respect for patient autonomy.

    本研究の目的は、倫理支援を担う者の能力について(1)臨床及び倫理推論に基づく判断の構成要素を探索的に明らかにすること、（2）臨床及び倫理推論に基づく判断の尺度を開発することである。 2019年度は、臨床推論、倫理推論、臨床倫理推論に関する文献レビューから、臨床倫理判断の構成要素を抽出し、尺度案を作成する計画を立てた。また、倫理支援として昨今、倫理コンサルテーションの体制を持つ病院が増え、多様な背景の者が担っている。臨床倫理に関心を持つ者が事例を検討する視点について明らかにすることを同時に行うこととした。現在、倫理支援者の能力尺度の開発に向けて構成要素を検討中である。また、医療従事者が倫理的問題事例について議論する際の視点や論点について分析中である。 加えて2019年度は、英国臨床倫理サポートの実践者を視察し、英国と日本での臨床倫理サポート体制及び普及について情報交換を行った。英国では、急性期医療現場における個々の事例の倫理的問題に対しては、Clinical ethics supportを設置している病院もあるが、医療専門職の判断と本人や家族との間で治療に関する意向が対立する場合、裁判所という判断を委ねるシステムが確立されている。病院内での倫理支援は医療従事者が意思決定する際に、法律、裁判例、倫理的に重要な概念、ガイドラインについて情報提供といった教育的支援がされていた。 日本では医療従事者と患者や家族と対立し、解決に至らない場合に裁判所に委ねることより、現場で解決する仕組みとして臨床倫理コンサルテーションがが発展している。当事者間で納得できる意思決定となる支援を実践している。教育的支援以上に調整し合意形成が行われていることを見いだした。調整、合意形成の実践に必要な能力も検討することとした。

    Our working hypothesis is the ethics of unity and difference. The former embodies attitudes of mutual support based on the belief that people are companions. The latter embodies attitudes of mutual non-interference based on the belief that people are strangers. The two ethics are mingled with balance and construct individual and social ethics. When we started our research, our agreements are: (1) Ethical judgement is made based on a doer's attitude associated by their assessment of the situation, which association results in their action; (2) The three principles in clinical ethics are respect for human beings, beneficence, and social appropriateness; (3) Shared process of decision-making; (4) Medical treatments should be performed directly towards the biological life, to improve the life as a human being. Through our research, we succeeded at confirming the working hypothesis and putting the system of clinical ethical case analysis into practical use based on the agreed four theories.

    The present research project could produce five significant results. Firstly, we set up a hospital ethics committee consultant liaison conference and could establish a network where experts involved in clinical ethics consultation gather, and we held the conference four times. Secondly, we clarified issues related to our ethical consultation and future research topics. Third, we established a process of second opinion small group team ethics consultation and made ethical proposals for two consultation requests. Fourth, we conducted literature research on core competency required for clinical ethics consultants and clarified its essence. Finally, we were able to develop the results of this research as an empirical research on ethical issues involved in surrogate decision making in Japanese clinical settings.

    In this research project, we developed a decision-making support tool as a "document template" aiming to promote common understanding among patients - medical personnel in making medical decisions and verify the effectiveness of them went. We reviewed the existing literature as the first stage and developed a working template consisting of a number of stakeholders as the second stage. The documented templates were attached to the electronic medical record. In order to verify the effectiveness of the developed template, we conducted a multicenter collaborative preliminary comparison study with 8 facilities. Decision Conflict Scale Japanese version (DCS), Decision Regret Scale Japanese version (DRS) as the endpoint, deviation degree between expert's preference towards decision making and patient's preference was adopted. Eventually 87 patients in the nonintervention group and 88 patients in the intervention group were enrolled.

    This research aims at elucidating the structure of bioethics in Asian countries through the method of Three-Level-Analysis. This year we applied the method to the theme of "organ transplantation" in addition to those of the previous years, i.e. "end of life care" and "reproductive medicine". We also summarized the results of the three-year research. Concretely, this year we conducted the research into the bioethics in China, Korea, Iran, India, Thailand, Pakistan, the Philippines, Russia, and Bangladesh, and held the international seminar on bioethics on 7-8 December at Kumamoto University. What they presented was published in Eubios Journal of Asian and International Bioethics.

    We conducted several qualitative and quantitative surveys concerning patient-health professional communication and provided the results of the surveys. Based on the results, we inspected conceptual framework of new relationship between patients and health professionals. We also explored ethical norm of health professionals in modern culture. Then we developed some tools which assist daily health care and decision making process in clinical setting.

    We analyzed bioethical arguments in Japan through various areas such as end-of life care, reproductive medicine, medical genetics and based on three level analysis, i.e., the level of medical practices, concrete principles and ethical theories, and so we made clear the feature of bioethics in Japan, such as bottom up character. Also we found out, by reexamining the relationships among three levels, that so called bioethical principles are universal because they are abstracted from various practices, and that the first level and the third level are closely connected with each other.

    <Background> With a change of patient-physician relationship model, professionalism of Japanese physicians seems to diminish. <Objective> To enhance medical professionalism of physicians, we aimed to explore conceptual contents of medical professionalism in Japan, to conduct surveys asking physicians professional attitudes and behaviors both to physicians and patients, to develop educational programs concerning medical professionalism for students and young physicians, and to search appropriate prescriptions enhancing professionalism of current Japanese physicians through the evidence. <Results 1: Conceptual discussion log and qualitative research about professionalism> In addition to having case based discussions about professional behaviors among physicians, we conducted qualitative focus groups to patients and co-medical staffs. We found that key concepts of medical professionalism were imagination to patients' suffering and interest, thinking balance between patients' interest and fairness, and Noblesse Oblige. <Results 2: Physician and patient survey concerning professional attitudes and behaviors> Internet-based survey and postal survey were conducted. We found that patients and general Japanese people were much more critical against unprofessional attitudes and behaviors than physicians themselves thought. We also found that gifts from pharmaceutical companies may affect prescription behaviors of physicians. <Results 3: Development of educational program enhancing professionalism of physicians> We developed two effective educational program enhancing medical professionalism : Cinema-based discussion program and significant event analysis for medical professionalism. <Results 4: Working environments and job satisfactions among physicians> We conducted a survey asking working status, job satisfactions, and attitude to patients to physicians. Lack of autonomy had a significant relationship with physician job satisfactions and attitudes to their patients. With these results, we held a forum for professionalism in which several types of medical professionals as well as ethics experts, mediators, the media, and representatives of patients attended searching for new model of patient professional relations. We finally made a proposal of professional declarations of Japanese physicians.

    Self-determination is a central concept in the field of bioethics and the most critical decision among the myriad of decisions concerning medical care is the decision to choose to die ; "self-determination of death." The purpose of this research is to clarify the basic positions on self-determination of death held by present Japanese people and we tentatively sorted these positions into 10 arguments. They included "Self-determination is incapable of existing," "Self-determination is not desired," "Self-determination does not apply to death," "Self-determination of death cannot be realized," "Respecting self-determination of death inflicts harm on others," "Self-determination of death is forced upon the patient," "Life is always most important," "Self-determination of death is recognized only under certain conditions," "Self-determination of death is for another's benefit," "Self-determination of death should be recognized." We discuss the problems and implications of these positions revealed within our present review and conclude that a society needs to deny unnecessary intrusion and tolerance for different views might be a keyword in our oncoming society. In the second year, we also investigated Japanese bioethics scholars' attitudes toward medical research, health science, healthcare, and society. Literature review revealed that Japanese scholars shared common ideas in terms of research ethics and the importance of research subjects' informed consent. On the other hand, various thoughts and perceptions were observed regarding the relationship between medical progress and the happiness of people.

    We conducted a total of 25 semi-structured interviews. Participants were nonmedical professional citizens ranging from the ages of 42 and 68 with an average age of 54 years, 92 percent of participants were periodically visiting a medical institution; 68 percent of participants have had experience as an inpatient.In total,interviews consumed 1,782 minutes ranging between 37 and 119 minutes per interview and averaging 71 minutes. Transcription sections with high associations were selected, coded and categorized. Sampled categories and subcategories of trust and distrust within the context of medical treatment are as inflows: 1) medical knowledge and ability: evaluation based on past experience, word of mourn and physician's personal nature; 2) suitable response: valid vs. invalid, manner and behavior; explanation and understanding, limitatins; 3) emotion: a priori, sense of social duty, expression of emotion, personal character, consideration and sympathy, psychological care, mutual understanding. Several influential fectors were identified beyond those of an adequate explanation of tneatment to patient, the quality of treatmoent and suitable outcome, and a physician's attitude. Stages of physician evaluation are seen to be relative to a patient's degree of involvement in medical treatment: prioritization of skill and technique, prioritization of psychological and emotional care, pricritization of patient autonomy and impartiality between patient and physician, and lastly, external evaluation When comparing these results to similar research conducted abroad, there appeare to cxist several aspects independent as well as dependent on cultural and national contexts. In particular, the desire for various forms of physician-patient relationship, the many characteristics related to emotion and the inevitable tendency for Japanese patients to rely on their physician are surmised to be tmique to Japan's clinical setting

    The issue of hospitalization for non-medical reason is one of the critical problems in Japan, related to various aspects of the social, cultural, and health care system issues in Japan. It is considerd to contribute to a long length of stay at hospital in Japan. It is first of all:necessary for us to approach to this complicated issue, based on the cycle of evaluation, planning, action and re-evaluation. In this study, we performed a literature review to identify a definition and classification of "hospitalization for non-medical reason" and two cross-sectional questionnaire surveys regarding decisions of discharge date from hospital. The literature review showed that there is no widely accepted definition and classification of "hospitalization fro non-medical reason". Therefore, we proposed our own definition of "hospitalization for non-medicalreason" based on the findings of extensive literature research. Questionnaire surveys showed that patients and their families held a locus of control for deciding a day of discharge. "Hospitalization for non-medical reason" was a common phenomenon in patients regardless of the post-discharge necessity of chronic care. Limitations of the current questionnaire surveys include small sample size and sampling bias. A further research is mandatory to explorer nation.-wide situation of "hospitalization for non-medical reason".
