I will analyze in this paper the problem of so-called "Altlasten" in the new federal states (the Land of Saxony, Brandenburg, Mecklenburg-West Pomeranian, Saxony-Anhalt, Thuringia)through the concept of risk-transformation, which has been used in the Niklas Luhmann's social system theory. According to Luhmann, various types of "technological-ecological risks" are transformed into the specific political risks by the political system as one of the function systems of modem society. The political system has to assume the "technological-ecological risks" with regard to the results produced by political-administrative decisions. Luhmann applied this concept only to the (political) function system, but I think that this concept can be used also for the organizational types of social systems. That is, "technological - ecological risks" will be transformed into the risks for each organization, therefore each organization makes a different response to that risks. This concept "risk transformation" implies the similar meanings to the Ulrich Beck's concept of "social rationality", but I think that the former can formulate the "system reference (Systemreferenz)" more accurately than the latter. In 1992, the negotiation system was built by the Treuhandanstalt (THA) , the Land of Saxony, the Federal Government, and the firms in question in order to solve the problem of Altlasten (old improperly disposed of harmful waste). In this negotiation system, THA, which was founded primarily in order to facilitate the privatization of new federal states, though, acted against this purpose. Because it was important for THA to manage the limitary funds as savingly as possible. That is to say, the "technological-ecological risks" of Altlasten was transformed by the THA into the risks of ruing its motto "saving". THA had responded to this new transformed risks rather than to the "technological-ecological risks" of Altlasten directly. The social system theory will make a large contribution toward fertilizing the risk research by refining this concept"risk-transformation".

福祉国家からリスク社会へという社会変動を論じるU.ベックらが主として問題にしていたものの一つに、いわゆる「包摂と排除」の問いがある。これは、80年代当時のドイツにおいて、CDUによって「新しい社会問題」と呼ばれ、SPDと緑の党によって「三分の二社会」と語られていた事態ともかかわっている。このような状況の中で、人間がそのライフコースの中で遭遇する数々の「社会的リスク」に対する防御や補償を担うべき審級としての社会的援助(soziale Hilfe)、社会福祉活動(Soziale Arbeit)あるいは(広い意味での)ソーシャルワーク、社会教育(Sozialpadagogik)といった制度もまた大きな変容を被っている。本稿では、こうした「社会的リスク」を背景とした他者への援助・福祉を、N.ルーマンの社会システム理論、とりわけその宗教諭を手ががりとして考察するものである。ルーマンは、一つの機能システムからのある人間の排除が他の機能システムからの当該人間の排除を呼び込むという、複数の機能システムの「否定的カップリング」という今日的現象の中で、援助の可能性を何処に求められうるかを探っている。そのさい、彼が着目するのは宗教システムである。しかし、60年代以降のいわゆる「世俗化」テーゼを知る者にとってはこの立論はいささか無理があるようにも思える。だが、ルーマンは、機能システムの「機能(Funktion)」領域と「遂行(Leistung)」領域とを区別し、前者(宗教システムでいえば「教会(Kirche)」)の近年の相対的な弱体化は、後者(宗教システムでいえば「ディアコニー(Diakonie)」)の強化によって埋め合わせられているのだと考え、この「遂行」のレベルにこそ、「否定的カップリング」に対処しうる宗教システムの「新しいチャンス」を見いだそうとする。もっとも、規範のレベルにとどまらないその具体的現実化の方途の問題とともに、ディアコニーの宗教的性格の程度に由来する問題は、依然として残されている。

Since the 1980s, the governing structure of modern society has been shifting from "Government to Governance", that is, "from vertical governance by state to horizontal governance by various actors such as state, business, NPO, etc." . In this research, we studied such changes in the governance structure in relation to "risk society theory" and "audit society theory". The following became clear through research. That is, the concepts of “risk management” and “auditing” have been greatly expanded beyond the original meaning, have become applicable throughout the day-to-day activities of organizations and society, and these concepts became a fundamental elements of the governing principles of organizations and society.

The aim of this project was to construct a platform for Sociological Study and Research about the Great East Japan Earthquake．To understand comprehensively the damages caused by this complex‐Earthquake, Tsunami,and Nuclear ccident‐and widespread disaster, this project built research sections as follows ; (1) Theory,(2)Evacuation,(3)Reconstruction,(4)Disaster prevention and reduction (5)Energy,(6)Data-base. Research outcome of the researchers engaged in this project were 195 papers, 132 oral reports and 37 books. In addition, we have published annual research reports named “Sociology in the Post-Disaster Society”five volumes.

1.初年度に収集した、少数ながら現存する水害予防組合への聞き取り等による資料を整理し分析し、その存続が、必ずしも住民の〈水防〉への意識に根ざすものではなく、実質的には〈治水〉と〈水防〉との乖離と評される戦後日本の河川治水のあり方の延長線上にあることを示した。2.他方で、水害リスクへの認識を保持し続けようとする試みとして、(1)北海道南幌町で、数十年間続けられている「治水感謝祭」の取組について資料を収集し、ヒアリングを行った。ここではこれらの行事を通じて、過去の大規模な水害と治水の努力についての集合的記憶を構築し水害リスクを常時意識化しようとしている。(2)これと類似した事例として、大分市の大野川と乙津川の中州に位置する高田輪中に赴き、過去の激しい水害の経験を伝承しそれをまちづくりに生かそうとする取組について資料収集した。また、安全・安心のまちづくりを水害や防犯までを含めて総合的に進めるモデルケースとして、3.先進的な「春日井市安全なまちづくり協議会」の取組についてもヒアリングと資料収集を行ったが、これは現在、行政主導型の組織構成へと変化せざるをえない転換期にあり両義的な状況にある。また、4.本研究を補完する、防災教育に関わる実践として、津波災害が危惧される道東の釧路市、かつて水害に苦しんだ経験をもつ札幌市白石区等において、学生や地域住民ともにDIGと呼ばれる災害図上訓練やフィールドワークを行い、また地域住民を対象に社会学的な視角から自主防災組織に関わる講演を行った。5.理論的には、社会学的リスク研究の動向について、リスクと教育という観点も含めたより広い視野から、この方面に関心を有する研究者と討論する機会をもち、「再帰的な近代」へと移行しつつある現代社会を観察するパースペクティブとして、リスク社会論が有効でありその認識枠組みを彫琢してゆくべきことを、再確認した。

1. In contemporary Japanese communities, community care systems cannot be constructed in the same form. Therefore, it is necessary to select a comparative approach in order to analyze these systems. 2. (1) In rural areas, it can be observed that characteristic community care systems are built in villages and towns. (Ex. Yasuoka village, Takeshi village, Ogawa village in Nagano prefecture) In these cases, a lot of actors which supply care service for the aged cooperate, and medical institutions lead this cooperation. In these cases, medical doctors who work in hospitals of these villages highly concern community care and they endeavor to construct community care systems. (2) In urban areas, it is difficult to build community care systems. In these areas, amount of actors which supply care service for the aged is very huge, so these actors cannot cooperate easily. But there is a case in which a private hospital leads construction of a community care system (Senju area in Tokyo). (3) In areas of isolated islands, it is difficult to build community care systems. In these areas, a most important issue of community medicine is to save patients. In these circumstances, medical doctors and officers are mainly interested in improvement of medical conditions. But there is a case in which residents of a community try to construct a community care system (Hateruma island in Taketomi town in Okinawa prefecture). 3. A medical sector is very important for constructing community care systems. (1) It is necessary for medical institution to take part in community care systems. (2) It is desirable for medical doctors to accept a idea that care is more important than cure. (3) It is possible for a medical sector to destroy a chance to build community care system. But a medical sector also can change these circumstances.
