    研究計画で予定していた個々のテーマについて検討を行い、今日の国際組織が海洋法において果たす役割の動態的な展開(紛争解決、法定立、ガバナンス、非国家主体との連携協力等)を把握する作業を進めた。 今年度取り扱った具体的な論点は、島の地位、航行、海上での法執行、海洋科学調査、漁業資源管理、海洋汚染(プラスチックごみ)、北極海等である。特に、国家管轄権外区域における生物多様性の保全（BBNJ）という比較的新しい問題については、目下国連で進むBBNJ新協定交渉を国際法の理論的観点から分析、検討した研究書を刊行した。この問題について国際的に関心が高まりを見せている中、日本で初となる本格的な研究書を本プロジェクトから刊行できたことは、大きな成果である（研究期間延長後の2021年8月に刊行した）。 また、研究代表者、研究分担者の編著による最新の研究論文集（『現代国際法の潮流ⅠおよびⅡ』）、国際法の基本書（『ビジュアルテキスト国際法（第2版）』、『国際環境法講義』）、条約集（『ベーシック条約集』）等も刊行している。また、一般向けの図書として、本研究の成果の一部を含む新書（坂元『あなどってはならない中国』）等も発表し、今日の海洋をめぐる国家間紛争とその法的処理の特質、課題等について最先端の研究成果を一般読者に届けることができた。国際的な研究成果としては、国際学会での研究発表、研究分担者と海外研究者の共同学会報告等がある。

    2019年5月に『世界万国の平和を期して―安達峰一郎著作選』（研究代表者が編者）を出版した。公表された学術論文や随筆のみならず、外交官として書き記した口上書や調書や報告書、日露戦争の捕獲審検所評定官としての調査書や判決、国際連盟や万国国際法学会での報告書、常設国際司法裁判所所長としての報告書や命令・勧告的意見に対する反対意見などを一冊にまとめた、安達峰一郎の最初の著作集である。フランス語を主とする欧文著作（書簡を含む）も巻末に一括して掲載した（100頁あまり）。この著作集の出版によって、安達の業績が内外に一層広く知られることとなることが期待される。 また、6月15日には東京で、安達峰一郎記念財団の主催で「よみがえる安達峰一郎―世界が称賛した国際人に学ぶ」という記念シンポジウムが開催された。200名近くの参加者を得て、安達の思想と行動が現在の混迷する国際社会にとって持つ意義について、熱心な討論が行われた。研究代表者が基調報告を務め、複数の研究分担者も個別報告を担当するとともに、パネルディスカッションにも参加した。 また、国際法協会日本支部が主催して、2019年4月27日に「日本における国際法学の誕生」という共通テーマでの研究大会が行われた。研究分担者の三牧が「大戦間期の戦争違法化と安達峰一郎」というテーマで報告を行った。 海外の史料館の一次史料の収集作業も引き続き行った。ベルギーの外交史料館で再度の一次史料の収集作業を行った。これまでほとんど知られていない、黒澤二郎関連の史料をかなりの数収集できた（“Correspondance politique Japon”や13.584など）。

    Through the four-years' joint and coordinated research work of Japanese scholars on the law of the sea and successive workshops on the law of the sea between Japanese and Chinese scholars, this research work has contributed to the identification and clarification of the contemporary issues relating to the interpretation and application of the UNCLOS and analysed various problems having arisen in the process of the implementation of the UNCLOS after its entry into force including issues concerning the demarcation between the continental shelf and the deep sea bed, definition of the island and rock, suppression of pirates, experimental whale catching, the claim of historic title over vast areas on the high seas etc. Through this research totally 61 articles and 3 books focusing the contemporary issues on the law of the sea has been published.

    The purpose of this research is to conduct a comprehensive research concerning the legal system and legal theory in order to recover and reconstruct after a large-scale disaster.     The year 2012 marked the twentieth anniversary of the adoption of the United Nations Convention on the Law of the Sea (UNCLOS); however, international society has not only faced difficulties around the implementation, interpretation, and application of UNCLOS, but has also encountered issues that were not anticipated at the time of UNCLOS’ adoption in 1982. This research addresses this resulting “vacuum” in the law of the sea. Collaborating with scholars and diplomats from East Asia (China, Taiwan, and the ASEAN countries), we have published several journal articles and books, and have organized international workshops on key problems such as dispute settlement and maritime delimitation. This research project has also succeeded in establishing an international network of specialists in the field.

    The objective of the present research was to invite Shigeru Oda, former Judge of the International Court of Justice, and to study the process of how judgments of international tribunals are formed. In pursuit of this aim, through case studies, we have studied the procedure of the court from the “inside", so to speak, focusing on how the Judges perceived the context of the conflict, how the perception was maintained/modified by collegial deliberation, how this was reflected in the operative part of the judgment, and how this has lead the ICJ to a conclusion that would have a large possibility of substantially contributing to the settlement of the dispute. Moreover, we reached many findings and common understandings on how the arguments of the conflicting parties(arguments of Agents and Counsels) and the manner the judges digested them has influenced the preparation of the judgment in each cases. As of the present, we are preparing our contributions by reorganizing the result of our case studies according to topics in judicial procedure. A book with the provisional title of “The Law and Procedure of International Tribunals" is planned for publication this year, and the deadline for the contribution is set at July 30th of this year. The book will include a case-by-case analysis section that will briefly organize the result of the case studies, to provide greater understanding of the multifaceted aspects of the judgment formation processes of international tribunals. As byproducts of the study, much of the findings gained from the research activities of the study group have already been published as research presentations and articles by individual members.

    The head investigator and the investigators, after 2001,have formed research group "the Japanese Institute for the Law of the Sea : JAILOS". So the research result of JAILOS means the result of this research project. In JAILOS, at the beginning, in order to keep doing long term research, it was recognized that it is necessary to decide fundamental viewpoint. Then, paying attention to the feature that regime of the law of the sea have been formed on the basis of the long term national custom, they thought that the historical analyses are necessary. So the research regarding the history of law of the sea was made until 2004. As the result of this research which is 1st period of this project, JAILOS published the book "Historical Development of the Law of the Sea". On the basis of the result of historical research, in 2005 and 2006,the 2nd period of the research, JAILOS made the research on some significant cases which have their influence on the development of the regime of the law of the sea afterward. The result of this research was published in 2007 March as "The Influence of Landmark Cases in the Law of the Sea". When these research activities are done, JAILOS did also the international research collaboration in the field of law of the sea. Then JAILOS held the Japanese-Chinese law of the sea workshop in 2006 October in the Tsinghua University, Beijing China, by cosponsor ship with the Chinese Law of the Sea Institute.

    The aim of this research project is to examine how to contribute to ensure the effective accountability of international organizations in this contemporary global community. There are so many international organizations in various fields in this global society at the moment. The main focus of this research project is on the Recommended Rules and Practices (RRPs) prepared by the International Committee on Accountability of Internationa1 Organizations established by the International Law Association (ILA) in 1996. The Head Investigator of this research project, Prof. UEKI, had joined as a Member of this International Committee since 2000, and various debates and works in this Committee to prepare these RRPs was very valuable academic resources for the research on the accountability of international organizations. As the result of very active academic works by this International Committee, the Final Report of the Committee, including final RRPs on Accountability of International Organizations, was presented to the 71st Conference of ILA in August 2004 held in Berlin, and adopted by the Conference. These RRPs have been consisted by Three Parts. PART ONE of the RRPs provide the rules on the First Level of Accountability, namely internal and external scrutiny in general. PART TWO is related to the Second Level of Accountability, namely Primary Rules and Recommended Practices on liability/responsibility of international organizations. PART THREE of the RRPs concerns the Third Level of Accountability, namely Secondary Rules and Recommended Practices on responsibility of international organizations. Lastly, PART FOUR provided the rules on remedies against international organizations. As a whole, these RRPs are a series of specific and guidelines derived from principles aimed at achieving effective accountability regime of international organizations, and it was remarkable academic achievements in this area on international law.

    As a result of this research, several articles were published both by English and by Japanese. As far as the articles written by Japanese, for instance, "The Legal Validity of ｀Countermeasures´ under General International Law in International Economic Dispute" was published in Hogaku (The Journal of Law and Political Science) in August 2000, and "Dispute Settlement by Political Organs of the United Nations" were published in "100 YEARS OF JAPAN AND INTERNATIONAL LAW" (edited by the Japanese Association of International Law), Vol.9 in October 2001. Since May 2000, as a Member of the International Committee on Accountability of International Organizations in International Law Association (ILA), I have participated several meetings of the Committee in London in July 2000, at the Peace Palace in the Hague in Netherlands in March 2001 and in the University College London in December 2001. At the meeting in the Hague, I have submitted to the Committee jointly with Prof. Ki-Gab PARK in Korea University "Responsibility for Violations of International Law by International Organization" (Working Paper for the ILA's Committee on Accountability of International Organizations). Based upon these research, I could publish the article "Responsibility of International Organizations and the Role of the International Court of Justice" in LIBER AMICORUM, JUDGE SHIGERU ODA" (edited by N. Ando, E. McWhinney and R. Wolfrum),Vol.1 in March 2002 At the 104th Annual Meeting Autumn Session of the Japanese Association of International Law, held in Doshisya University in Kyoto in October 2001, I have played a role as the Coordinator of the Second Session "International Organization and Responsibility".

    本研究は、現代の国際社会において国際組織が果たしている国際紛争の平和的解決機能の諸相を、多面的視座から実証的に検討し、これを国際法体系全体の中に理論的に位置づけて体系化することを目的とするものである。そのための具体的な研究として、まず第一に現代の国際社会において最も重要な役割を果たしている国連の紛争解決機能に関しては、平成10年度及び平成11年度のそれぞれにおいて秋の国連総会開会中にニューヨークの国連本部へ各1週間ほどの実地研究に赴き、法律問題を所掌する国連総会第六委員会における審議の実情を調査し、多くの点を肌に感じて学ぶことができた。また、貿易・経済紛争の処理機関として1995年の発足以来その重要性を増しつつある世界貿易機関(WTO)の紛争処理機能についても、その前身であるGATTの紛争処理機能と対比しつつ検討を行い、その研究成果を平成12年3月にポーランドのルブリン大学にて発表した。これらの研究成果を理論化して中間的に発表したものが、研究論文「『国際組織法』の体系に関する一考察(四)(五・完)--『国際組織法総論』構築への予備的考察」『法学』62巻3号(1998年)・63巻2号(1999年)である。また、本研究の別の角度からの研究成果として、国際組織の「アカウンタビリティー」という観点からの研究をまとめ、本年中に論文として発表する予定(『法学』64巻3号)であり、さらに本研究の成果の一部は、間もなく刊行される予定の国際法学会百周年記念出版『日本と国際法の百年』(三省堂)の第9巻『紛争と裁判』に所収の論文「国連の政治的機関による紛争解決」としても公表の予定である。

    最近の国連の安全保障理事会が採択した国連憲章第七章の下での法的拘束力ある「決定」に関するさまざまな資料を収集・整理し、これを法的に分析することを通じて、現段階の国際社会において国際組織が現実に果たしている法的機能を明らかにすることに努めた。特に、国際組織の決定や決議が国際法上のみならず国内法上どのように各国によって受けとめられ、その国内的履行が図られているかを体系的に究明した。 以上の国連の安全保障理事会の「決定」に関する研究で得られた成果を足がかりとして、国際組織に関する諸問題を国際法と国内法の双方がいかなる形で規律しているかを、国際組織法の一般理論-いわば「国際組織法総論」として体系的に構築する作業が可能となった。主権国家を中心として組み立てられてきた伝統的な「国際法」の体系が、今日において国際組織の果たしている積極的な法的役割の影響によって、どのような変容を遂げているかを明らかにすることは、今日の国際法学における最も重要な課題の1つであるが、本研究はそのような理論的探究を可能にするための法的素材を提供する貴重な意義を持つものであると言える。 このように、本研究は、従来研究が進んでいなかった国連安保理決議の国内的効力の問題という実際的見地から重要な意義を有する課題について一定の究明を行うと同時に、「国際法」の伝統的体系の変容とその際の「国際組織法(総論)」の役割といった国際法の基本理論に関して新たな学問的成果を収めるものでもあったと言える。
