日本学術振興会特別研究員、東京大学大学院医学系研究科特任助教、昭和大学研究推進室講師、国立がん研究センター生命倫理部長を経て、現職。
専門は、社会学、生命倫理学。

学部・大学院と社会学の研究室で過ごし、医学部や病院で生命倫理に関する教育・研究に10年間取り組んだ後、社会学の研究室に戻りました。医療と社会の接点で起きる、さまざまな出来事に関心を持っています。

INTRODUCTION: Older adults represent a growing proportion of patients with cancer. However, confirmatory randomized controlled trials (RCTs) continue to rely primarily on tumor-based endpoints such as overall survival (OS), which may overlook outcomes particularly important to older adults, including quality of life (QOL), functional status, and treatment tolerance. This review aimed to systematically characterize the primary endpoints used in confirmatory RCTs enrolling adults aged ≥65 years and to evaluate how novel endpoints reflecting patient priorities were defined and analyzed. MATERIALS AND METHODS: PubMed, CINAHL, and the Cochrane Library were searched for English-language confirmatory RCTs exclusively enrolling adults aged ≥65 years with cancer and reporting a primary endpoint (up to January 19, 2024). Endpoints were classified as conventional (tumor-based) or novel (non-tumor-based). Data were extracted on endpoint definitions, measurement tools, and statistical approaches. RESULTS: Of 822 records identified, 66 RCTs met the eligibility criteria, yielding 71 primary endpoints. Conventional outcomes predominated (n = 53; 74.6%), with OS being the most frequent, followed by progression-free survival and disease-free survival. Novel endpoints (n = 18; 25.3%) included health-related QOL (HR-QOL), toxicity, geriatric assessment-based measures, composite endpoints, and patient satisfaction. HR-QOL was most commonly assessed using the European Organization for Research and Treatment of Cancer QLQ-C30. Definitions of toxicity and functional decline varied across studies. Variance assumptions were rarely reported, and minimal clinically important differences were inconsistently applied. Additional endpoints, such as quality-adjusted survival, overall treatment utility, and disability-free survival, were infrequently reported. DISCUSSION: Survival remains the predominant endpoint in confirmatory RCTs involving older adults with cancer, while patient-relevant outcomes are inconsistently incorporated. Addressing these gaps may facilitate more patient-centered trial designs and improve the real-world applicability of research findings for the aging cancer population.

BACKGROUND: Discussions on do-not-attempt-resuscitation (DNAR) orders are considered critical end-of-life discussions with patients with advanced cancer; however, patients are not necessarily involved in these discussions. Therefore, we aimed to clarify oncologists' practice, perceptions, values, and attitudes regarding DNAR orders and to identify factors associated with oncologists' attitudes toward confirming patients' preference for DNAR orders. METHODS: Oncologists in designated cancer hospitals in Japan were surveyed using a self-administered questionnaire. Multivariate analyses were performed to identify attributes to attitudes toward confirmation of patients' preferences. RESULTS: Among 688 participating oncologists, 477 (69%) indicated that they would confirm patients' preferences when issuing a DNAR order if they were competent. Independent variables for positive attitudes toward confirming patients' preferences before issuing DNAR orders included "Talking about DNAR is severely distressing for family" (Odds ratio (OR) = 2.459, p < 0.001) and "It is burdensome to prepare for discussions regarding DNAR orders" (OR = 1.450, p = 0.002) and the value "Non-maleficence" (OR = 1.384, p = 0.012). On the other hand, independent variables for negative attitudes included "Patients do not need to know about DNAR if their family members know about it" (OR = 0.329, p < 0.001) and "Talking about DNAR orders is severely distressing for patients" (OR = 0.443, p ≤ 0.001) and the values "Preference of family" (OR = 0.687, p = 0.012), "Lack of training and education on discussing DNAR orders," (OR = 0.731, p = 0.006), and "It is hard to talk about death" (OR = 0.758, p = 0.026). CONCLUSION: Oncologists' discomfort talking about death and their perceived distress for patients and their families were associated with their attitudes towards discussions about DNAR orders.

Although the approaches to obtaining informed consent in clinical research have diversified, a method for long-term follow-up research of childhood cancer survivors remains to be established. Typically, legal guardians provide consent for children’s participation in childhood cancer research. However, for long-term follow-up research, obtaining informed consent directly from the participants once they have reached the age of autonomous decision-making is essential. Achieving this necessitates considering a method that enables obtaining non-face-to-face informed consent. Specifically, implementing “informed consent by electronic method,” as outlined in the Ethical Guidelines for Medical and Health Research Involving Human Subjects, would be desirable, depending on the research content and security strength of the electronic system used. Moreover, obtaining informed consent through electronic data capture entails the management of personal information within an electronic system, thereby necessitating robust information security infrastructure. In this context, we developed a “Safe Server” to ensure data security. To address the abovementioned issues, we, “the Long-term Follow-up Matsumoto Group,” are in the process of establishing a nationwide long-term follow-up system as part of the Comprehensive Research Project for the Promotion of Cancer Control. In this paper, we propose an approach for obtaining informed consent and describe the information security system that underpins this proposal.

Background: In Confucian-influenced Asian societies, explicit end-of-life conversations are uncommon and family involvement in decision-making is crucial, which complicates the adoption of culturally sensitive advance care planning. Aim: To develop a consensus definition of advance care planning and provide recommendations for patient-centered and family-based initiatives in Asia. Design: A five-round Delphi study was performed. The rating of a definition and 84 recommendations developed based on systematic reviews was performed by experts with clinical or research expertise using a 7-point Likert scale. A median = 1 and an inter-quartile range = 0–1 were considered very strong agreement and very strong consensus, respectively. Setting/participants: The Delphi study was carried out by multidisciplinary experts on advance care planning in five Asian sectors (Hong Kong/Japan/Korea/Singapore/Taiwan). Results: Seventy-seven of 115 (67%) experts rated the statements. Advance care planning is defined as “a process that enables individuals to identify their values, to define goals and preferences for future medical treatment and care, to discuss these values, goals, and preferences with family and/or other closely related persons, and health-care providers, and to record and review these preferences if appropriate.” Recommendations in the domains of considerations for a person-centered and family-based approach, as well as elements, roles and tasks, timing for initiative, policy and regulation, and evaluations received high levels of agreement and consensus. Conclusions: Our definition and recommendations can guide practice, education, research, and policy-making in advance care planning for Asian populations. Our findings will aid future research in crafting culturally sensitive advance care planning interventions, ensuring Asians receive value-aligned care.

We outlined five studies regarding the quality of the review by committees based on the Act on the Safety of Regenerative Medicine. The findings raise serious concerns about the independence, integrity, and quality of reviews of therapeutic plans by these committees with inappropriately close relationships to medical institutions and companies.

BACKGROUND: The International Council for Harmonisation of Technical Requirements for Pharmaceuticals for Human Use (ICH) is undertaking a major revision of ICH E6 Good Clinical Practice (GCP) decided to involve external stakeholders in ICH-GCP renovation. Activities such as surveys and public conferences have taken place in the United States, European Union, and Japan. For stakeholder engagement in Japan, a designated research group conducted a survey of academic stakeholders. METHODS: A total of 105 academic stakeholders from 18 institutions responded to the survey. The research group developed recommendations reflecting the survey results and the opinions from patients and the public. RESULTS: The survey showed the top four principles needing renovation were (i) informed consent (Chapter 2.9, 12.4% of respondents believed it needed renovation), (ii) systems for quality assurance (Chapter 2.13, 9.5%), (iii) information on an investigational product (Chapter 2.4, 5.7%), and (iv) procedures on clinical trial information (Chapter 2.10, 5.7%). The top three sections identified as needing renovation were: (i) informed consent (Chapter 4.8, 27.6%), (ii) monitoring (Chapter 5.18, 22.9%), and (iii) composition, functions, and operations of the ethics committee (Chapter 3.2, 14.3%). Recommendations included clarification of ICH-GCP's scope, proportionality in various aspects of clinical trials, diversity and liquidity of ethics committee members, modernization of informed consent procedures, variations in monitoring, and regulatory grade when using real-world data. CONCLUSION: The recommendations from Japanese investigators and patients have been submitted to the ICH E6 Expert Working Group, which will strengthen the robustness of the GCP renovation.

BACKGROUND: Whether and how to disclose genomic findings obtained in the course of genomic clinical practice and medical research has been a controversial global bioethical issue over the past two decades. Although several recommendations and judgment tools for the disclosure of genomic findings have been proposed, none are sufficiently systematic or inclusive or even consistent with each other. In order to approach the disclosure/non-disclosure practice in an ethical manner, optimal and easy-to-use tools for supporting the judgment of physicians/researchers in genomic medicine are necessary. METHODS: The bioethics literature on this topic was analyzed to parse and deconstruct the somewhat overlapping and therefore ill-defined key concepts of genomic findings, such as incidental, primary, secondary, and other findings. Based on the deconstruction and conceptual analyses of these findings, we then defined key parameters from which to identify the strength of duty to disclose (SDD) for a genomic finding. These analyses were then applied to develop a framework with the SDD matrix and systematic decision-making pathways for the disclosure of genomic findings. RESULTS: The following six major parameters (axes), along with sub-axes, were identified: Axis 1 (settings and institutions where findings emerge); Axis 2 (presence or absence of intention and anticipatability in discovery); Axis 3 (maximal actionability at the time of discovery); Axis 4 (net medical importance); Axis 5 (expertise of treating physician/researcher); and Axis 6 (preferences of individual patients/research subjects for disclosure). For Axes 1 to 4, a colored SDD matrix for genomic findings was developed in which levels of obligation for disclosing a finding can be categorized. For Axes 5 and 6, systematic decision-making pathways were developed via the SDD matrix. CONCLUSION: We analyzed the SDD of genomic findings and developed subsequent systematic decision-making pathways of whether and how to disclose genomic findings to patients/research subjects and their relatives in an ethical manner. Our comprehensive framework may help physicians and researchers in genomic medicine make consistent ethical judgments regarding the disclosure of genomic findings.

Li-Fraumeni syndrome (LFS) is a hereditary tumor that exhibits autosomal dominant inheritance. LFS develops in individuals with a pathogenic germline variant of the cancer-suppressor gene, TP53 (individuals with TP53 pathogenic variant). The number of individuals with TP53 pathogenic variant among the general population is said to be 1 in 500 to 20,000. Meanwhile, it is found in 1.6% (median value, range of 0-6.7%) of patients with pediatric cancer and 0.2% of adult patients with cancer. LFS is diagnosed by the presence of germline TP53 pathogenic variants. However, patients can still be diagnosed with LFS even in the absence of a TP53 pathogenic variant if the familial history of cancers fit the classic LFS diagnostic criteria. It is recommended that TP53 genetic testing be promptly performed if LFS is suspected. Chompret criteria are widely used for the TP53 genetic test. However, as there are a certain number of cases of LFS that do not fit the criteria, if LFS is suspected, TP53 genetic testing should be performed regardless of the criteria. The probability of individuals with TP53 pathogenic variant developing cancer in their lifetime (penetrance) is 75% for men and almost 100% for women. The LFS core tumors (breast cancer, osteosarcoma, soft tissue sarcoma, brain tumor, and adrenocortical cancer) constitute the majority of cases; however, various types of cancers, such as hematological malignancy, epithelial cancer, and pediatric cancers, such as neuroblastoma, can also develop. Furthermore, approximately half of the cases develop simultaneous or metachronous multiple cancers. The types of TP53 pathogenic variants and factors that modify the functions of TP53 have an impact on the clinical presentation, although there are currently no definitive findings. There is currently no cancer preventive agent for individuals with TP53 pathogenic variant. Surgical treatments, such as risk-reducing bilateral mastectomy warrant further investigation. Theoretically, exposure to radiation could induce the onset of secondary cancer; therefore, imaging and treatments that use radiation should be avoided as much as possible. As a method to follow-up LFS, routine cancer surveillance comprising whole-body MRI scan, brain MRI scan, breast MRI scan, and abdominal ultrasonography (US) should be performed immediately after the diagnosis. However, the effectiveness of this surveillance is unknown, and there are problems, such as adverse events associated with a high rate of false positives, overdiagnosis, and sedation used during imaging as well as negative psychological impact. The detection rate of cancer through cancer surveillance is extremely high. Many cases are detected at an early stage, and treatments are low intensity; thus, cancer surveillance could contribute to an improvement in QOL, or at least, a reduction in complications associated with treatment. With the widespread use of genomic medicine, the diagnosis of LFS is unavoidable, and a comprehensive medical care system for LFS is necessary. Therefore, clinical trials that verify the feasibility and effectiveness of the program, comprising LFS registry, genetic counseling, and cancer surveillance, need to be prepared.

Ethical considerations are more stringent in pediatric clinical research than in research targeting adults. However, in Japan, clear guidelines have yet to be presented on the necessary ethical considerations for clinical research involving children. The "Principles of Ethical Consideration Required for Clinical Research Involving Children" provide guiding principles for ethical considerations and the essential ways of thinking that all involved in clinical research on children need to understand in advance.

BACKGROUND: To promote precision oncology in clinical practice, the Japanese Society of Medical Oncology, the Japanese Society of Clinical Oncology, and the Japanese Cancer Association, jointly published "Clinical practice guidance for next-generation sequencing in cancer diagnosis and treatment" in 2017. Since new information on cancer genomic medicine has emerged since the 1st edition of the guidance was released, including reimbursement for NGS-based multiplex gene panel tests in 2019, the guidance revision was made. METHODS: A working group was organized with 33 researchers from cancer genomic medicine designated core hospitals and other academic institutions. For an impartial evaluation of the draft version, eight committee members from each society conducted an external evaluation. Public comments were also made on the draft. The finalized Japanese version was published on the websites of the three societies in March 2020. RESULTS: The revised edition consists of two parts: an explanation of the cancer genomic profiling test (General Discussion) and clinical questions (CQs) that are of concern in clinical practice. Particularly, patient selection should be based on the expectation that the patient's post-test general condition and organ function will be able to tolerate drug therapy, and the optimal timing of test should be considered in consideration of subsequent treatment plans, not limited to treatment lines. CONCLUSION: We expect that the revised version will be used by healthcare professionals and will also need to be continually reviewed in line with future developments in cancer genome medicine.

Background: When the suffering of a terminally ill patient is intolerable and refractory, sedatives are sometimes used for symptom relief. Objective: To describe the main principles of revised Japanese clinical guidelines about palliative sedation therapy. Design: Consensus methods using the Delphi technique were used. Results: The main principles of the guidelines that were newly defined or developed are as follows: (1) palliative sedation was defined as "administration of sedatives for the purpose of alleviating refractory suffering" (excluding the aim of reducing patient consciousness); (2) palliative sedation was classified according to the method of administration of sedatives: respite sedation versus continuous sedation (including (continuous) proportional sedation and continuous deep sedation); (3) a description of state-of-the-art recommended treatments for difficult symptoms such as delirium, dyspnea, and pain before the symptom was determined as refractory was included; (4) the principle of proportionality was newly defined from an ethical point of view; and (5) families' consent was regarded as being desirable (mandatory in the previous version). Conclusions: We described the main principles of revised Japanese clinical guidelines about palliative sedation therapy. Further consensus building is necessary.

OBJECTIVE: The objective of this study is to assess public attitudes toward pharmaceutical companies' secondary uses of patient records and public preferences regarding consent approaches. METHOD: 3000 responses to an online survey were collected from adults in Japan. The questionnaire included 32 items related to (1) awareness of "clinical trials"; (2) awareness of the processes of drug development, such as cost, time, and the number of candidate substances in a new drug; (3) knowledge of the laws and regulations for use of patient records in Japan; (4) assessment of the public benefit of the secondary use of patient records; (5) preferences for consent for the secondary use of patient records; and (6) basic characteristics of the respondents. RESULTS: The public benefit from secondary use of records by academic institutions for scientific research was rated highest. All of the activities by pharmaceutical companies were rated higher than those by governmental institutions and other for-profit companies. Regarding consent approaches, 37.9% preferred an "opt-in" approach for new drug development by pharmaceutical companies, 79.7% of whom would change their preference to an "opt-out" approach under specific conditions, such as ensuring intended uses only. CONCLUSION: Our respondents consider the "public benefit" as dependent on the relative distance from "promoting public health" when assessing the secondary purpose of patient record use. Pharmaceutical companies should include the beneficial purposes when using patient records with "opt-out" approach. Policy makers should pay more attention to the purposes of use when developing personal information protection policies.

Although the Japanese government has been promoting academia-industry collaboration since the 1990s, inappropriate relationship between some companies and researchers has become a problem. The government has issued the guidance for conflict of interest (COI) management, which will need to be revised as per the current situation in the hospitals. The objective of this study was to examine the current situation of COI management structure in Japanese hospitals that may be involved in multi-center clinical trials. We sent questionnaires on topics relevant to COI management to 590 hospitals. Among the 190 respondents (response rate＝32%), 100 hospitals had independent COI management committees. The committees had an average of 7 members, including one external member. In 76 hospitals, the secretariat of COI management committee was placed in the administration and management department. In the previous year, 48 committees collected additional information from researchers through interviews and 35 committees provided advice. Our survey showed wide diversity among hospitals regarding management standards and activities of independent COI management committees. However, they shared a common point in that the COI management committees do not function actively. Although the Clinical Trials Act has provided a standardized COI management strategy, further studies are required to develop more practical guidelines for COI management in clinical trials.

Governmental regulations and external review mechanisms for biomedical research were introduced in Japan in the late 1980s. However, there are two major problems yet to be overcome: 1) lack of a clear definition of research and 2) inconsistency among regulations for the protection of participating human subjects. In this paper, I discuss these two problems referring to the recent development of administrative guidelines over biomedical research in Japan. Regarding the former, the 2007 version of the Guidelines for Epidemiological Research introduced a standard for the distinction between research and medical practice. However it does not tell us how the gray zone between research and practice should be regulated. Regarding the latter, the 2008 version of the Guidelines for Clinical Research introduced a stricter regulation for those clinical trials which use already approved drugs or medical devices. Although these new guidelines lead to more consistent regulations, there is still a significant difference among guidelines regarding their binding powers.

The purpose of this paper is to clarify the logical construction of Robert J. Levine's model for the distinction between research and therapy. Levine's model has been adopted in well-known ethical guidelines such as the Belmont Report (1979) and the CIOMS guidelines (1993). Levine introduced into research ethics two theoretical models, the intent-based model and the approval-based model, for the distinction between research and therapy. He also recommended that physician-investigators deal with "innovative therapy" as research, which should be reviewed by IRBs. Levine criticized two assumptions which were largely shared in the medical community in the 1960's. Some physician-investigators thought that it was impossible to distinguish research from therapy because all medical practice was in a sense experimental. Others thought we should distinguish therapeutic research from non-therapeutic research and that the former can be conducted according to relatively relaxed standards. This was also the standpoint of the Declaration of Helsinki in 1964. These assumptions interfered with effective regulation of clinical research. Levine's model introduced a new perspective into research ethics and became a foundation of the contemporary regulation of clinical research. The purpose of this paper is not only to reconstruct past discussion and share its heritage but also to obtain suggestions for the regulation of clinical research in Japan.

①《皆一緒》と《人それぞれ》の理論の哲学的検討研究代表者は、本プロジェクトが医療における意思決定プロセスの望ましいあり方として提唱してきた《情報共有-合意モデル》も、社会が要請する人間関係の倫理に対応しており、日本国憲法に表された国民のいのちや健康を守る宣言の実質である国民間の相互扶助（皆一緒）と人権（人それぞれ）のバランスに相応しているとした。他の分担者は同モデルが共同意思決定（SDM）の一種であることから、内外におけるSDMの理論を多面的に検討し、そこから現代に相応しいあり方を探ろうとした。 ② ポスト健康寿命期（＝老いによる人生の最終段階）にある高齢者のウェルビーイングの条件の明確化研究代表者が提示する見解：ポスト健康寿命期を人生の最終段階と位置付け、「寿命は長ければ長いほど良い」から「長短を評価に使わず、本人が自分らしく、前向きに生きられることこそ重要である」への価値観のシフトを提唱するに際して、WHOも緩和ケアをプライマリー・ヘルスケア等と統合する方向で活かしていこうとしていること等を検討しつつ、緩和ケアの長さよりも質を大事にする考え方（ただしこれは《長さ》を全く否定するのではなく、《人生の充実を伴わない長さ》を否定するものである）を目下の文脈で活かしていく道を探った。 ③研究成果の臨床現場への還元および社会に向けての提言による社会貢献サイト「臨床倫理プロジェクト（臨床倫理ネットワーク日本内）」を整備し、これまでの研究成果に基づく9本の動画を作成してサイト内コンテンツに加え、臨床従事者が研究成果を理解して実践に活かせる環境作りを進めた。また、本研究課題を行う主たる研究機関である岩手保健医療大学に臨床倫理研究センターを発足させ、医療・ケア従事者や本研究に関心を持つ市民が参加できるオンライン懇話会を6回開催した。

本研究の目的は、最近の世界的な医療研究開発・政策の焦点となりつつある小児希少性・難治性疾患や遺伝性疾患の患者など、これまでは「社会的弱者」とされ、保護の対象として臨床研究から外されてきた者、とりわけその中でも小児や「未生の存在」である胎児を中心に、これら社会的弱者を積極的に臨床研究の被験者として用いる時代に対応した、研究倫理の新たな倫理的・法的原理基盤および倫理審査の判断基準等について検討することにある。研究２年目となる本年度は、年度を通してCOVID-19流行に伴う国内・国外の移動制限を余儀なくされたことから、次年度以降の予定を含めた当初計画についていくつかの変更を加えて、班員各自が在宅勤務等でできる範囲の作業に絞り込み、主に理論研究あるいは事例分析研究など、本研究課題に関連する中での各自の関心テーマに基づく個別研究の実施を進めた。これら個別研究と並行して、本研究課題に取り組むにあたっての根本的な問題意識として班員が共有していた、「ゲノム編集児の誕生を伴う臨床研究」の問題事例を取り上げて、当該研究に内在する研究倫理学上の倫理的課題について班員全員で分析し、海外学術雑誌への投稿を目標として論考作業を進めて、英文論文草稿を書き進めるに至った（次年度の投稿を予定）。更に、本研究が扱う「社会的弱者」の１つとして従来認識されてきた高齢者を取り上げて、COVID-19に関連付けたテーマでの事例分析と論考作業を進め、こちらについては海外学術雑誌への投稿まで進めることができた。

本研究は、高齢者や認知症患者を対象とした医療上の意思決定支援向上のために、ディシジョンエイド（Decision Aid：DA）の枠組みに基づき、推奨される情報提供の在り方を検討・開発することを目指している。本年度は、１）高齢者に対して推奨される情報提供に関する情報取集、２）プロトコール立案（介入対象・方法・アウトカム設定など）、３）高齢者に多い疾患に関わる専門家へのヒアリングを行った。１）では、高齢者では特にポジティブな感情を引き起こす情報に不均衡に注意が向くとされる社会情動的選択性理論の観点や、ユニバーサルデザインの領域で蓄積された情報提供の手法などを鑑みる必要性が明らかになった。２）では、同一内容について切り口を変えて情報提供を行った際のアウトカム設定などを中心に議論を行い、既存のスケール（Decision Conflict Scale, Decision Regret Scaleなど）の適応可能性なども検討した。その結果、対象者の特性を考慮すると、本研究では具体的な疾患・治療選択場面を例にして、情報提供に関する現場のニーズを把握するとともに、専門家パネルでの情報ツール作成などを通し、医療者および利用者にその有用性や満足感などを尋ねる手法が望ましいと考えられた。３）では、TAVI（経カテーテル大動脈弁植え込み術）、心房細動に対するアブレーション治療、乳がんの3領域の専門家に、高齢者および認知症患者を対象とした治療選択場面で、患者とのコミュニケーションや情報提供に関するニーズを聴取した。いずれの領域でも認知機能低下を有する患者に向けた同意取得や情報提供についての課題が同定され、今後は、DAを用いた介入に適するかの視点でより詳細な検討が必要であることが明らかになった。

We tried to analyze the ethics in our society using the two principles of human relationship: "live by helping each other" and "live and let live," and recognized that, e.g., Paternalism, besides Aristocracy, was natural and even might have been appropriate in societies where the former principle was dominant, while respect for autonomy is absolutely recognized in those where the latter one is dominant. In Japanese society nowadays, by contrast, a balance between the two principles should be sought, which can be actualized in medical contexts by our version of shared decision-making. "Post healthy life-span" is the period when elderly people are living with frailty. It is said to last for about ten years on average. The period is appropriately understood as "end-of-life period" and advance care planning (ACP) for this period should be promoted. We made support tools for elderly people's ACP, as well as contributed to some authorized guidelines for ACP.

2018年度分の研究活動（2018年4月～2020年3月）の実績の概要は以下の通り。当年度は、まず、総合調整班において全体的な研究計画と調査項目・検討課題を決定した。具体的には、先行研究課題である科研費・基盤研究(A)（課題番号24243017）の研究成果として、米村編『生命科学と法の近未来』（信山社、2018）が公表されているため、これを素材に国内外の関連研究者・専門家等からの意見と課題提示を受けた上で、総合調整班において検討を行った。その結果、現在の日本では臨床研究法をめぐる法運用が多大な混乱を惹起しており、医学界からは臨床研究全体が抑制されているとの指摘も見られるため、臨床研究法の法規制のあり方を検討することが適切と考えられ、海外法制度調査もその観点を中心に行う方針とした。以上をもとに、一般的実体要件班・一般的手続要件班において、国内の法学・生命倫理学・医学関係者に臨床研究法の問題点や改善の方向性等につき意見聴取を行うほか、海外の文献調査や国外の機関に対する訪問調査を行う方針とした。国内調査に関しては、各研究分担者の調査内容を研究会の場で共有したほか、永井良三・自治医科大学長や藤井眞一郎・理化学研究所生命医科学研究センターチームリーダーなど医学研究者の意見を直接聴取した。また、ドイツの臨床研究規制については、ヨッヘン・タウピッツ教授を始めマンハイム大学医事法研究所のスタッフに調査を依頼しており、その中間報告を数度にわたり聴取したほか、フランスの臨床研究規制についても文献調査の形で調査を進め、2019年3月に研究分担者・磯部哲と研究協力者・河嶋春菜の助力によりフランス渡航調査を実施した。特殊研究規制検討班においては、研究分担者・徳永勝士を中心に、国内研究機関や海外研究機関・研究者に対するヒアリング調査を行う形でゲノム研究や再生医療研究の規制状況の調査を行った。

Our working hypothesis is the ethics of unity and difference. The former embodies attitudes of mutual support based on the belief that people are companions. The latter embodies attitudes of mutual non-interference based on the belief that people are strangers. The two ethics are mingled with balance and construct individual and social ethics. When we started our research, our agreements are: (1) Ethical judgement is made based on a doer's attitude associated by their assessment of the situation, which association results in their action; (2) The three principles in clinical ethics are respect for human beings, beneficence, and social appropriateness; (3) Shared process of decision-making; (4) Medical treatments should be performed directly towards the biological life, to improve the life as a human being. Through our research, we succeeded at confirming the working hypothesis and putting the system of clinical ethical case analysis into practical use based on the agreed four theories.

We worked on establishing a nation-wide academic infrastructure for research, education, and supporting systems of clinical research ethics which contributes to the improvement of ethical quality of clinical research and the better governing function of clinical research ethics. Many academic articles on research ethics theories and ethics review methodologies including a collection book of domestic research ethics cases were published; several educational and supporting tools for ethics reviewers and ethics supporting personnel for clinical research were developed; and a database of clinical research ethics consultation cases and a pooled candidates list of well-trained potential external board members for research ethics review committees were also developed.

This research examined the basic ideas supporting hospice palliative care practices in the manner of carefully interpreting the texts written by and about the pioneers of hospice palliative movement, as well as engaging in dialogues with hospice palliative care practitioners. This led to the following eleven basic conceptions; such as “hospice movement”, “hospice palliative care”, “total pain” and “spiritual care”, “quality of life ” and “well-being”, “natural death”, “eating”, “home care”, “community”, “death” and “dying”, “care for the dying”, and “hope”. Publishing the research findings in the journals and books noted elsewhere, this research contributed to strengthen the philosophical foundation of hospice palliative care.

In order to establish new medical research governance for 21st century, we have developed a new interactive system in which patients continuously communicate with medical researchers and input their heath data for medical research. We first carried out survey and analysis of similar activity in the UK and the US, and also conducted an opinion survey of Japanese patients about use of ICT. These research works showed that there is potential for patient-centered activities for medical research in Japan. We then constructed an actual web-system and consulted members of patient groups about the contents of the system and procedures for utilization that need amendments. The system is now almost ready for the implementation with rare disease patients with neuro- muscular diseases.

In the research project, we conduct a questionnaire survey of bereaved people who had cared for a family member until their death while receiving home hospice care service. The questionnaire is designed on the base of preliminary studies including fieldwork, historical examination, and international comparison on this topic. In the survey, responses from a total of 663 people were collected. The analysis reveals details of the anxiety and needs patients and their family have, as well as mixture of religious, economic, and social interest in their attitudes toward life and death.

We designed a questionnaire to measure patients’ understanding of cancer clinical trials. That questionnaire includes eight domains as below: purpose, procedures, risks, benefits, voluntary, supporting after participating in a trial, burden of expense and implementation structure. We performed pilots testing and surveys using that questionnaire. We revealed the test-retest reliability of that questionnaire was good with intraclass correlation coefficients. We could not conclude the validity of that questionnaire because of the small sample. We continue to perform that survey to identify the validity of that questionnaire.

1.We re-evaluated the HIV tainted blood product incident in Japan in 1980's in terms of the systems approach of the study of medical safety; we conducted several interviews toward the corporate members who belong to one of the pharmaceutical makers of blood product and we tried to take this problem from the perspective of the sexually transmitted HIV infection.2.We re-examine the Yakugai concept by comparing HIV incident with the other Yakugai such as thalidomide case. In addition, we examine the various attempts governmental or NPO base for the proper use of pharmaceutical products in terms of the regulatory science.3.We evaluated the current reality of the Yakugai education introduced into the curriculum of the Japanese compulsory school education and the preparatory practical trainings of the medical and pharmaceutical departments.

がんの親を持つ子どもや、がんの親との死別を体験した子どもに対する支援の在り方を検討する上で、まずは、実態を把握するための調査を実施した。 ①がんの親の療養や死別を経験した子どもに対する支援の在り方について、子どもの生活の基盤である学校現場における支援の実態を調査するため、小中学校の教職員を対象にアンケート調査を実施した。有効回答者数832名のうち、回答者の学校の半数以上において、がんの親の療養や死別を経験した子どもに対する支援は構造化されておらず、教職員が個別対応を実施している状況であった。そのうち、実際に児童生徒の支援に関わったことがある教職員は133名（15.9%）で、60%以上は担任教師であった。支援の内容として、様子の変化に注意したり、普段の会話量を増やすといった関わりを中心に行っていたことが明らかとなった。 ②在宅でがんの親の療養や看取りを経験した家族が求める支援を明らかにすることを目的として、がん在宅療養の死別体験のある親2名を対象に構造化面接を実施した。その結果、親のがんが治らないことを子どもに伝えることに対する躊躇や困難があったことが語られ、実際に子どもに話す際には在宅医や訪問看護師が同席した家庭もあった。学校に対しては、「子どもには通常と変わらない生活をさせてほしい。」という母親の願いがあり、いずれの家庭でも担任教師には状況報告のみが行われていた。また、親が療養している時期から、死別後の子どもに対する支援について配偶者が情報を受け取ることができるよう、病院での情報提供が強く求められた。 ③小学生から中学生の子供を持つがん患者を対象にした冊子「お子さんと“がん”について話してみませんか」を作成し、全国の拠点病院に支援体制の実態に関するアンケートとともに送付した。介入方法に悩みをもつ施設も多く、医療現場において広く利用できるツールとして修正を加えた完成版を作成した。

Our study aimed to analyze various narratives of Japanese clinical trial participants for better protection of future participants and to build a website for sharing our interview data to the public. We applied the same methods used by the Oxford Health Experiences Research Group and 41 patients from various conditions joined our study. We conducted qualitative data coding and prepared for a website. The majority of them became interested in clinical trials for personal benefits and didn’t have clear impression about informed consent as a decision-making process. We reported our interim results at several academic conferences including British Sociological Association. We held a symposium on February 2015 and 96% of the audience evaluated that they were “very satisfied” and “satisfied”.

In this research, we started with the question, if and how "European societies” such as Sweden, Germany, Britain, France, and Italy are "secularized" or "medicalized". However the trend towards "secularization" and “medicalization” is various in accordance with such major factors in background as religion, family, social system, and courtesy and therefore not easily generalized. This is why we first took a general view of the hospice palliative care development in Europe, focusing on the preceding projects of the European Association for Palliative Care. Then we investigated the introduction and the subsequent development of palliative care in European countries. Finally we came to examine end-of-life care practices and their philosophical foundations of Cicely Saunders, so as to form a clear view of the question, if it is possible to trace "routinization", "secularization" or "institutionalization" of hospice palliative care to its own origins.

We have improved our system of case examination in clinical ethics through examination of its philosophy and method of case examination, and published the improved system as textbooks, an online version, and e-learning materials. We also participated in making the guidelines for the decision-making process concerning artificial hydration and nutrition for elderly people by the Japan Geriatrics Society (2012), and as a result, the guidelines recommend the "information-sharing and consensus-seeking model," which is a type of shared process of decision-making, and one of the most basic elements of our system. Again, we have developed and published series of "Notebook of the process of decision-making for patients and their families" concerning a few topics. We organized "Clinical Ethics Seminar" 48 times in cities across Japan in association with local groups of collaborators during the 4 year study period, and a total of 6700 medical and health workers attended them.

In this study, I focus on a controversial case in Japan about a randomized withdrawal trial of antidepressant, and analyze ethical and social issues underlying it. In conclusion, I suggest that there are three major issues to be considered (1) ethical issues in study design, (2) regulation of clinical trials in Japan, and (3) patient participation in clinical trials at the planning phase.

本年度は、(1)昨年行った臨床試験に関する訴訟の事例研究、およびがん患者へのインタビュー調査の成果を学術論文として公刊するとともに、(2)外科領域における研究規制のあり方について研究を行い、その結果を学術論文として公刊することによって、「研究と診療の区別」という観点から、あるべき被験者保護システムの方向性を提示した。まず(1)については、金沢大学無断臨床試験訴訟における医師側の主張の論理構成を詳細に読み解くことを通じて、医師の視点からみた研究倫理の特徴とその課題を明らかにした。具体的には、本事例では画一的な治療法を普及させるための教育・啓発活動として臨床試験が実施されており、それが研究倫理の基本的な枠組みを掘り崩しかやないことを指摘した。加えて、がん患者へのインタビュー調査からは、既存の医療システムが終末期患者のニーズを十分に満たしていないことが明らかになり、患者の視点から臨床試験のあり方を見直していくことの重要性が示された。次に(2)については、従来の医薬品や医療機器の開発を念頭においた被験者保護システムが十分に機能していない外科領域をとりあげ、外科の技術革新をどのように規制するべきかという問題を検討した。外科の領域は、医師や医療チームの経験・技術が大きく影響するため、画一的な研究規制は困難だとされている。そこで、外科手術の革新に関しては、従来の「研究ルート」のみならず、「診療ルート」を通る道を提示することで、個別ケースに即した有効な規制が可能になるという視点を提示した。以上、本研究では、望ましい被験者保護システムのあり方について、概念的・歴史的・実証的アプローチによる多面的な研究成果を生み出すことができた。くわえて、本年度は、これらの研究成果に基づいたアウトリーチ活動を重点的に行い、研究成果を積極的に社会に還元していくことにも成功した。
