    令和5年度においては、これまでの研究成果の一部を、日本社会保障法学会において、ミニシンポジウム「社会保障法における家族の位置づけ―扶養義務との関係を中心に」として発表した。具体的には、倉田が、児童扶養手当に焦点をあてて、家族に生じる所得保障ニーズにおける公私の役割分担を検討し、家族の変容などに伴い、両者の関係性の相対化を論証した。また、中野は、福祉サービスの利用者またはその扶養義務者が負担する利用者負担の範囲や水準の設計は、扶養にかかる公私の役割分担の問題に関わるという観点から、介護保険、子ども・子育て支援新制度および老人福祉法・児童福祉法に基づく福祉の措置について、利用者負担において家族がどのように位置づけられているかを歴史的経緯を含めて考察し、扶養義務を巡る議論も参照しながら、利用者負担の仕組みが有する課題を検討した。嵩は、生活保護法77条による扶養義務者からの費用徴収の構造と特徴を検討するとともに、同条の適用が少ない行政実務の実践に、憲法24条を淵源とする「家族のなかの『弱者』の保護」という理念を見出しうる可能性を指摘した。 そのほか、民法学の観点から、婚姻費用分担と生活保護費との関係にかかる分析、令和4年親子法改正の分析、嫡出否認・認知無効の訴えがなされた場合の子の監護に要した費用の帰趨の検討、さらに、成年後見法制の展開と役割を、比較法を踏まえて分析するなどの研究を進めた。また、社会福祉法制に関しては、未成熟の子が、家族を支える「ヤングケアラー」となる場合の支援策のあり方についての検討を展開した。手続法に関しては、子の引渡しを求める間接強制の申立てや婚姻費用分担審判と父子関係の存否の審理判断との関係に関し、近時の最高裁判決の分析を行った。さらに、家族関係が国境を超えることが増加していることから、民事上の紛争の国際裁判管轄等についての先端的な分析も行った。

    令和元年度（平成31年度）においては、手書きで書かれた穂積文書について活字化（翻刻）する作業を行い、穂積文書の全体像について検討を行った。 具体的な研究成果としては、穂積文書として残されていた手書きの文書が、基本的に法典調査会における法例に関する議事の準備として作成された文書であったことを確認するとともに、法典調査会における議論の前提としてどのような検討がされていたのかについて、一定程度、確認をすることができた。穂積文書には、法典調査会に提出される法例草案を起草するに至るまでの検討状況に関する情報、特に、参照した外国法制・外国研究者の文献に関する記述が残されていたため、条文毎にどのような検討を経て起草されたかについての分析を行うことができた。例えば、法典調査会に提出された草案27条では、公序則について「外国法ニ依ルヘキ場合ニ於テ其規定カ公ノ秩序又ハ善良ノ風俗ニ反スルトキ」とされていたものの、穂積文書における起草過程の当初においては「外国法ニ依ルヘキ事項ヲ定メタル規定ノ適用カ公ノ秩序又ハ善良ノ風俗ニ反スルトキ」とされており、現在の日本の国際私法学における一般的な考え方に整合的な文言（実際に、平成元年の法例改正において、穂積文書に残された当初案の文言に近い「外国法ニ依ルヘキ場合ニ於テ其規定ノ適用カ」という文言に修正されている）となっていたことが明らかとなった。また、法典調査会の議事速記録において条文毎に付された外国法制・外国研究者に関する情報の意義、例えば、「甲」「乙」といった記号で分類がされていた趣旨が何であったかといった点について、穂積文書の記載から明らかにすることができた。 以上のように、令和元年度においては、穂積文書の記載の全体像から萌芽期の日本の国際私法、特に、明治31年法例立法に関する経緯について、検討・分析をすることができた。
