本研究の初年度である2022年は、新型コロナウイルスの流行に伴う渡航規制が若干緩和されたものの、まだ海外における調査をコロナ以前のように実施することはできなかった。ただし、国内においては対面での研究会開催が本格化するなど状況は好転している。結果として、海外における資料およびフィールド調査については遅滞が生じているものの、国内の各種研究会、および資料分析についてはほぼ事前の計画通りに研究を遂行することができた。以下、本年度の実績を記載する：【海外での調査】8月に磯貝（健）、磯貝（真）の2名がウズベキスタンに出張し、タシュケントの東洋学研究所で資料調査を実施した。さらに、ヒヴァの国立イチャン・カラ博物館にて館長と面会し、同館所蔵文書の研究におけるパートナーシップの継続を確認した。ただし、同月から9月にかけて和崎が実施する予定であった現地での聞き取り調査はキャンセルとなった。【国内での研究会】7月に京都、12月に静岡で「近代中央ユーラシア比較法制度史研究会」を実施した。京都開催回では畠山が、近代ロシア家族史の研究動向について報告し、静岡開催回では阿部が、サファヴィー、カージャール両朝統治下のコーカサスにおけるシーア派相続法にかんする報告を行った。また、静岡開催会では「トルキスタン統治規程」の翻訳研究会も併せて実施した。さらに、2023年3月には「中央アジア古文書研究セミナー」を、対面参加者数の制限を廃した上でハイブリッド形式にて実施し、30名前後の参加者を得た。

Donation of one's own property to others had been widespread in various regions of the world since ancient times, and especially became popular in the Middle Ages. In this research, we held international research meetings in collaboration with overseas research groups of donation, focusing on Islamic waqf and comparing it with donations in Europe, the Middle East, Central Asia, South Asia, Southeast Asia, China, and Japan. Analyzing the differences in purpose, management, and social effects of donations in each region, personal motives (good deeds for salvation, fame, tomb construction, transfer of property) and social benefits (religious institutions, charity, economic infrastructure) were commonly discerned. Mixture of personal motives and social benefit, that is, being both egoistic and altruistic must have been the appeal of donation. In modern times when egoism and altruism were being separated, the waqf system and similar donations began to be reformed.

前年度の繰り越し事業として行った６月の日本ドイツ学会でのフォーラムをはさみ、本年度の調査前調査後の打ち合わせ研究会を３回実施し、フォーラムや現地調査参加者以外の研究分担者との情報共有を密に行い、11月に、初めてチェコ・プラハでの現地調査を実施した。チェコをはじめとする中欧の４か国（ハンガリー、スロヴァキア、ポーランド）は、EUの難民割り当てに対する抵抗勢力として知られているが、難民危機以前から、公的機関ではなく、NPOも難民・移民問題に取り組んでいることが確認できた。しかしながら、難民・移民問題は国民的課題とはみなされず、最近の研究関心は、むしろチェコから流出する移民に向けられている。同月にドイツ・ハレでの定点観測とハレの属するザクセン＝アンハルト州の州都マグデブルク、ハレに近いザクセン州のライプツィヒでの調査も実施した。ハレ市の移民統合専門官からハレ市のネットワークの現状と政局の影響の聴き取り、定点観測中のカシュターニエン大通り中等学校の現状に関する聴き取りとドイツ語クラスの参観、難民・移民児童の教育に効果を上げているとされる学童保育の参観、NPO運営の市民と移民の交流の場ウェルカム・トレフの見学、ハレとライプツィヒのモスクの見学と聴き取り、マグデブルクの州労働社会省の統合担当官の聴き取りと外国系園児の多いこども園の参観を行った。ハレ市のみならず、ザクセン＝アンハルト州全体としても移民・難民統合に向けて行政が積極的な政策を打ち立て、州としての独自性を保っていることが分かった。このように統合政策が順調とみられているハレ市であるが、現地調査直前に市外の犯人によるシナゴーグ襲撃事件が起こった。そのため、ハレ市のユダヤ人の歴史、最近のロシアからのユダヤ系移民の流入などについても追加的に調査した。市民の難民・移民統合への意欲、反人種差別主義の姿勢はむしろ高まったようである。

We had study meetings 30 times through which we analyzed the part of law of obligations of the Ottoman civil code (Mecelle) both collectively and individually. As a result, we published Japanese translation of the Books of Sale, Hire, Guarantee, and Transfer of Debt. We translated the Books of Pledges, Trusts and Trusteeship, Gift, Wrongful Appropriation and Destruction tentatively, then studied them in comparison with the other laws of obligations. These tentative translated Japanese texts are to be basic materials for comparative study of law of obligations between Islamic law and Western modern law, and making Mecelle as 'Modern Middle Eastern Law' model. We also held the international workshop related to Mecelle in Japan, and the research group leader had the invited presentation in the international Mecelle symposium held in Turkey, where he talked about this research project.

This research program has conducted a comparative study of waqf endowment,in collaboration with the CNRS International Research Program (GDRI) centered at Aix-Marseille University (headed by Professor Randi Deguilhem), holding the eight international workshops in Aix-en-Provence, Tunis, Birzeit (Palestine), Mascara (Algeria), New Oreans (USA), Ankara (Turkey) and Tokyo. This research clarifies the socio-economic role of waqf donation by cross-area comparisons among waqf, not only within the Middle East, but also to include Central Asia, South Asia, Southeast Asia, and similar endowments in China and Japan. Our goal was to find and locate both regional features and historical changes of the waqf and similar donations within the sweep of human history, based on a common definition of the waqf, by analyzing historical materials of each region from comparative perspectives on topics such as purpose,management, profit and its distribution, transformation and abuse etc.

We held study meetings nine times regularly a year (four times in the final year), and examined the Arabic text of the Ottoman Civil Code (Mecelle). In the end, we finally finished translating the Book on Sales (art. 101-403) and the Book on Hiring and Leasing (art. 404-611) into Japanese. We completed one third of the whole text of Mecelle. We also carried out investigations into texts, commentaries, monographs and articles related to Mecelle in various languages, and collected a part of them by purchase, photocopying and the other methods. We made electronic data of the Arabic version of Mecelle text, and improved our research by its use. We had some research presentations on adaptation of Mecelle in Afghanistan and Malay.

This research aimed to (1) collect various data of"nuptiality" trends (mean ages at marriage, parents' occupations, birth and residential places, dowry etc.)of the city of Damascus/Syria between 1921 and 1933,(2) input and (3) analyze them by some quantitative analysis. We have attained the results as followed :(1) women's mean age at marriage increased temporally in the middle of 1920s, but then subsided to the level of the beginning of the 20th century until 1934,(2) men's mean age at marriage increased unnaturally in the middle of 1920s, that is to say, three years higher than the level of the beginning of the 20th century. In conclusion, Damascene men encountered more"difficult" situations in comparison with Damascene women under the population"crisis" of the first half of French mandatory period.

The purpose of this research was to establish a basis, by using a historical demographic approach, for the study of social transformation processes in the Middle Eastern cities, particularly in Syrian cities from the latter half of the nineteenth century to the first half of the twentieth century In both summers of 2006 and 2007, surveys were carried out in Syria, and total 1332 data of marriage contracts of Damascus city in 1934 had been collected. 30 items from each contract were selected, abstracted and input In addition, data check and cleaning had been also finished. Through basic analysis of the above mentioned data, the following results have been achieved, the average number of marriages per month was 111, much more contracts were concluded in May and September-November (from 140 to 160). As far as Damascus was concerned, the mean age for men was 29.4, while for women 20.6 (for the first married women 17.2). These are reasonably to be expected. The remarriage rate in 1934 (29.8%) shows a considerable increase from that between 1902 and 1908 (14.2%). It might be due to a marked decline in the sex ratio of the Muslim population in Damascus in the late nineteenth century, or war damages of W WI and the Great Syrian Revolt (1925-1927). Contrary to our expectation, the range of marriage of Damascenes in 1934 had become possibly narrower than 1910s. One of the great 'discoveries' of this research was earned by the analysis of occupation data. Althoughnot yet sufficiently analyzed, we suppose that occupation was an important decision-making factor of spouse selection. Father's survival rate for both spouses, by counting 'dead' recorded in father's occupation, shows short life expectancy at that time. More than half of both men and women between ages 30 and 34 had already lost their fathers by death. Particularly for women after age thirty its rate sharply declines. We suppose that the fact is much important for women's nuptiality trends. In addition, we collected laws and regulations relating to marriage between 1881 and 1931, and translated them (written in Ottoman Turkish, Arabic or French) into Japanese.

This study aims at conducting basic researches for the construction of political and social data bases of the Middle Eastern Core Area. The Middle Eastern Core Area means a historical core area consisting of Egypt, Turkey and the Greater Syria (Syria, Lebanon, Jordan, and Palestine). We selected suitable documents for database formation from basic juridical, administrative and parliamentary documents such as official gazettes, statute books, parliament records, and government almanacs, et.al., focusing on modern Egypt and the Ottoman Empire that included both Turkey and the Greater Syria, and tried to input necessary information of key words in these documents by using their indices and other research sources. Main results of our study are the formation of data base of index of laws and regulations in the Statute Book of the Ottoman Empire (Duster) and the formation of data base Parliament Records in Monarchical Egypt (madhabit mails al-nuwwab and madhabit mails al-shuyukh)and its publication on website. We also tentatively tried to digitalize some parts of the Almanacs of the Ottoman Empire and the Official Gazette of Egypt (al-waqa'i' al-misriya) and and conducted a survey of basic historical documents of the problem of Capitulation for the preparation of data base formation of these sources.

7月にロンドンのLSE(ロンドン・スクール・オブ・エコノミクス)で催された第15回CIEPO(International Committee of Pre-Ottoman and Ottoman Studies)シンポジウムにおいて「The Urban Fabric of Damascus in the Middle of the 19^<th>Century : A Study of Tax Register(Rusum Defteri)」の題で発表を行ない、ダマスカスの都市構造を、街区構造、商業施設分布、家屋の賃貸額から再検討した。平成13年度5月の日本中東学会大会の発表と表題は同じだが、その後の研究の成果を盛り込んで内容も進展している点と、英語による国際学会発表である点が異なっている。会議終了後の1週間の滞在を利用して、大英図書館とパブリック・レコード・オフィスにおいて資料収集を行った。その後シリアへ赴き、ダマスカス歴史文書館において家族構造に大きな影響を与える死亡イベント分析のための遺産分割文書の閲覧・記録を行った。 12月に国立社会保障・人口問題研究所で催された第10回イスラム人口研究懇談会において「オスマン朝末期の人口構造」、2003年2月に東洋文庫で催された東洋史談話会において「オスマン朝末期のシリアの社会-家族・人口・戦争-」の題で発表した。どちらの発表も3年間の研究成果の最終報告として位置づけられる。 2月の発表の後、イギリス、シリア、トルコにおいて調査を行い、イギリスのパブリック・レコード・オフィスとトルコの総理府オスマン文書局では主にダマスカスのキリスト教徒、ユダヤ教徒の年齢分布、居住状況および移民についての資料を収集した。また、シリアのダマスカス歴史文書館での調査では20世紀初頭の遺産分割文書の閲覧・記録をほぼ終了した。3月中旬に京都外国語大学の中央アジアのイスラム法廷文書セミナーに参加し、シリアのイスラム法廷文書との比較のレヴューを行った。
